1. Who is responsible?

Protecting your personal data is particularly important to us – especially with a product like WHISK. We are committed to sustainability, responsibility and, of course, data protection. We attach the greatest importance to complying with all legal requirements and process your personal data exclusively as prescribed by the General Data Protection Regulation (GDPR), the Austrian Data Protection Act (DSG) and all other relevant laws. Only what is really needed is stored and processed.

This privacy policy is intended to help you understand how we collect, store, process, share and transfer personal data of our customers, website visitors, business customers, suppliers and other business partners. This also applies to persons working on behalf of these companies or who are their shareholders. We also explain how your data is processed when you use the WHISK app.

2. What data do we process?

Visiting the website and server logs

When you open the website, technically necessary data is processed to deliver the site and protect it against attacks. We use no tracking or advertising cookies and no analytics tools; fonts are loaded from our own server.

• Data: IP address, time, page visited, browser and operating system
• Purpose: delivery, stability and security of the website
• Legal basis: legitimate interest, Art. 6(1)(f) GDPR
• Retention: deleted after [7] days

Orders and pre-orders

• Data: name, email, delivery and billing address, phone number (if given), order contents, payment and shipping status, returns, correspondence
• Purpose: handling of order, deposit, remaining payment, shipping, invoice, warranty
• Legal basis: performance of contract, Art. 6(1)(b) GDPR, and legal obligations, Art. 6(1)(c)
• Retention: 7 years (§ 132 BAO), beyond that only while warranty periods or legal disputes are ongoing

Payment via Stripe

Payments are processed by Stripe Payments Europe Ltd. (Dublin, Ireland). You enter card details directly with Stripe – we never see them. Stripe’s privacy policy also applies.

• Data: name, email, amount, payment method, payment status
• Purpose: secure payment processing and fraud prevention
• Legal basis: performance of contract, Art. 6(1)(b) GDPR; for connections and control commands your explicit consent when signing in to the app (Art. 9(2)(a) GDPR), which you can withdraw at any time
• Retention: according to statutory retention periods

Shipping

For delivery we pass data to the respective shipping company.

• Data: name and delivery address; email only if you agree to shipment tracking
• Purpose: delivery of the goods
• Legal basis: performance of contract, Art. 6(1)(b) GDPR; for the email your consent, Art. 6(1)(a)
• Retention: until delivery or according to statutory periods

Enquiries by email or Telegram

For Telegram, Telegram’s privacy policy also applies; Telegram also processes data outside the EU.

• Data: name or username, email address, content of the message
• Purpose: answering questions, support, complaints
• Legal basis: performance of contract or pre-contractual steps, Art. 6(1)(b) GDPR, otherwise legitimate interest, Art. 6(1)(f)
• Retention: at most 3 years after the last message; if there is an order, according to statutory periods

WHISK app

WHISK is controlled via our web app. You sign in with your email address and confirm it with a 6-digit code that we send you by email. Your Wi-Fi name and password are stored only on the device and are not transmitted to us.

• Data: your email address, the serial number of your WHISK, connections and control commands
• Purpose: sign-in, linking device and user account, troubleshooting and providing use of the app
• Legal basis: performance of contract, Art. 6(1)(b) GDPR
• Retention: until you request deletion or deactivate your user account

Business customers, suppliers and partners

• Data: name, company, position, contact details, contract and billing data, correspondence
• Purpose: initiating and handling the business relationship, purchasing, cooperations, trade fairs
• Legal basis: performance of contract, Art. 6(1)(b) GDPR; for contact persons our legitimate interest in communication, Art. 6(1)(f); legal obligations, Art. 6(1)(c)
• Retention: for the duration of the business relationship, then according to statutory periods (7 years, § 132 BAO)

Stored only in your browser

Age confirmation, language choice and shopping cart are stored only locally in your browser (localStorage) and are not sent to us – the cart only when you submit your order. You can delete these entries in your browser at any time.

YouTube video

The guide page embeds a YouTube video (Google Ireland Ltd.) in privacy-enhanced mode. The video only loads when you click “Play video”; only then is your IP address transmitted to YouTube and Google may also transfer data to the USA.

Links to social media

Our profiles on Telegram, X and Instagram are only linked, not embedded. Only when you click a link do you reach the respective provider; their privacy policy applies there.

3. Who receives the data?

Only recipients who need it for the stated purposes, on the basis of law or a contract:

• Hosting of website and shop: Hostinger International Ltd., Larnaca, Cyprus (server location: Frankfurt am Main, Germany)
• WHISK app server and sending of the sign-in code: IONOS SE, Montabaur, Germany
• Payment provider: Stripe Payments Europe Ltd., Ireland
• Shipping company: mostly, but not exclusively, GLS
• Tax advisors, legal advisors, banks
• Authorities and courts where we are legally obliged

Where data goes to countries outside the European Economic Area (e.g. with Stripe, Google or Telegram to the USA), this is based on an adequacy decision of the European Commission (EU-US Data Privacy Framework, Art. 45 GDPR) or on standard contractual clauses (Art. 46 GDPR).

4. Your rights

• Access: whether and which data we process about you.
• Rectification: have incorrect or incomplete data corrected.
• Erasure: if the purpose no longer applies, processing is unlawful or you withdraw consent – unless a statutory retention obligation applies.
• Restriction: have processing temporarily blocked.
• Data portability: receive your data in a common, machine-readable format.
• Objection: to processing based on our legitimate interest.
• Withdrawal: withdraw consent at any time without giving reasons; this applies from that point on.
